A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH
LAKE TAHOE UPDATING THE CITY'S CURRENT CONFLICT OF INTEREST
CODE SET FORTH BY THE CALIFORNIA STATE FAIR POLITICAL PRACTICES
COMMISSION FOR ELECTED OFFICIALS, BOARD AND COMMISSION MEMBERS
AND EMPLOYEES OF THE CITY OF SOUTH LAKE TAHOE
(Amending Resolution No. 2012 -77)
RECITALS
WHEREAS, the Political Reform Act of 1974, Government Code Section 81000, et seq
requires state and local government agencies to adopt and promulgate conflict interest codes; and
WHEREAS, the Fair Political Practices Commission has adopted a regulation, 2 Cal. Code
of Regs. Section 18730, which contains the terms of a standard conflict of interest code; and
WHEREAS, such standard terms can be incorporated by reference and may be amended
by the Fair Political Practices Commission after public notice and hearings to conform to
amendments in the Political Reform Act:
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of South Lake
Tahoe as follows:
1. The terms of 2 Cal. Code of Regs. Section 18730 and any amendments to it duly
adopted by the Fair Political Practices Commission are hereby incorporated by reference and,
(W along with the attached Appendix A, in which officials, boards and commission members and
employees are designated, and Appendix B, in which disclosure categories are set forth,
constitute the conflict of interest code of the City of South Lake Tahoe.
2. Upon receipt of statements of the Members of the City Council, Planning Commission,
City Manager, City Attorney and City Treasurer, the City Clerk shall make and retain a copy and
forward the original of these statements to the Fair Political Practices Commission. Designated
employees shall file statements of economic interests with the City Clerk. All statements of
economic interests will be made available for public inspection and reproduction (upon request)
pursuant to Government Code 81008.

*Consultants shall be included in the list of designated employees and may be required to file

form. If a consultant participates in making financial decisions, said consultant is required to
disclose certain types of information so that the public can be made aware of any potential
conflict of interest. This form must be filed each year and is a public document. However,
the following limitation may apply:
The City Manger may determine in writing that a particular consultant, although a "designated position"
is hired to perform a range of duties that is limited in scope and thus is not required to comply fully
with the disclosure requirements described in this section. Such determination shall include a
description of the consultant's duties and, based upon that description, a statement of the extent of
disclosure requirements. The City Manager's determination is a public record and shall be
retained for public inspection in the same manner and location as this conflict of interest code.
The following positions are NOT covered by this code, because they are required to file full
disclosure with the Fair Political Practices Commission (by way of the City Clerk) under
Section 872000, and therefore, are listed for informational purposes only:

APPENDIX B
Disclosure Category 1: Must report all interests in real property located within the iurisdiction,
as well as investments, business positions and sources of income,
including, gifts loans and travel payments.
