RES 2013-073CITY OF SOUTH LAKE TAHOE RESOLUTION NO. 2013 - 73 RESOLUTION ESTABLISHING A HEALTH REIMBURSEMENT ARRANGEMENT WHEREAS, California Government Code Section 53216 authorizes a governmental or public agency or employer to establish and make contributions to retirement plans; and WHEREAS, the City of South Lake Tahoe currently pays a portion of a retirees' medical plan premium according to a vesting schedule for retirees over the age of 65 who are enrolled in Medicare; and NOW, THEREFORE, BE IT RESOLVED the City Council of the City of South Lake Tahoe hereby establishes an HRA benefit for its retired employees, effective December 1, 2013. RESOLVED FURTHER, that the eligibility requirements for retirees under this program shall be those retirees eligible for City health insurance who are over age 65. RESOLVED FURTHER, that the Council hereby adopts that certain plan known as the City of South Lake Tahoe Health Reimbursement Arrangement, effective December 1, 2013. RESOLVED FURTHER, that for purposes of clarification of administration of the HRA but not for the purposes of making said HRA subject to title I of ERISA, the Council hereby designates the Employer as the plan sponsor and administrator of the HRA. RESOLVED FURTHER, that the Employer shall make contributions to the HRA to fund said benefits. RESOLVED FURTHER that, for purposes of the limitations on contributions and benefits under the HRA, as prescribed in section 145 of the Internal Revenue Code of 1986, as amended, the "limitation year" shall be as defined under the terms and provisions of the HRA. RESOLVED FURTHER, that the Council hereby appoints the following individuals to comprise the HRA Committee: Nancy Kerry, City Manager; Janet Emmett, Human Resources Manager; Debbie McIntyre, Financial Services Manager. RESOLVED FURTHER, that the Council hereby appoints Keenan Financial Services as the contract administrator to assist the Employer in the implementation and administration of the HRA, and as Broker of Record to secure the annuity to fund the plan. Resolution No. 2013 - Health Reimbursement Arrangement Page 2 of 2 RESOLVED FURTHER, that MidAmerica Administrative and Retirement Solutions shall act as third party claims administrator for the HRA. RESOLVED FURTHER, that the Council hereby authorizes any member of the HRA Committee to execute such documents and to take such action as may be necessary for the proper implementation and operation of the HRA.
