RES 2013-032Resolution No. 2013 -32 A RESOLUTION OF THE SOUTH LAKE TAHOE CITY COUNCIL CONFIRMING THE REPORT OF THE ADVISORY BOARD OF THE SKI RUN BUSINESS IMPROVEMENT DISTRICT AND LEVYING THE ASSESSMENT REFERRED TO IN THE REPORT FOR FISCAL YEAR 2013 -2014 WHEREAS, on April 16, 2013 the South Lake Tahoe City Council adopted a Resolution of Intention to levy assessments within the Ski Run Business Improvement District as required by Streets and Highways Code Section 36534, and WHEREAS, on May 7, 2013 the City Council held a public hearing as required by Streets and Highways Code Section 36535, which was conducted in accordance with Sections 36524 and 36525 of that code, and WHEREAS, the City Council has considered the evidence and testimony submitted at that public hearing, and WHEREAS, the City Council did not receive written or oral protests against the levy of assessments of more than fifty percent (50 %) of the total assessments of the entire District, and WHEREAS, the City Council has determined that action is necessary and appropriate to ensure the continuation of the District. NOW, THEREFORE, be it resolved by the City Council of South Lake Tahoe that: 1. The recitals set forth herein are true and correct. 2. The report submitted by the Ski Run Advisory Committee is confirmed as originally filed. A true and correct copy of that report is attached hereto. 3. The 2013 -2014 budget submitted by the Ski Run Advisory Committee is adopted as modified. A true and correct copy of the budget is attached hereto. 5. The adoption of this resolution by the City Council shall constitute the levy of the assessments specified in the report for the fiscal year referred to in the report. The foregoing resolution was duly passed and adopted by the City Council of the City of South Lake Tahoe at a regular meeting on the h day of May, 2013, by the following vote: AYES: Councilmembers: DAVIS, COLE, CONNER & SUTANSON NOES: Councilmembers: ABSENT: Councilmembers: ABSTAIN: Councilmembers: t.
